Welcome to Lune's comprehensive Carrd of service terms. Because hy offers a variety of services that serve different purposes, a good handful of them also come with different terms. Please be sure to read and understand them thoroughly.
By commissioning Lune, you are agreeing to these terms and are hereby legally bound to them, whether you have truly read them or not. Lune is not responsible for any "unforeseeable" issues on your part.

Default tos
These are the terms I use for my commissions by default. Unless otherwise specified, please assume that your commission / request falls under these terms.
i. general terms
By default, my work is for personal use only. You must pay accordingly for commercial use.
I, the artist, will always reserve the right to refuse any commission requests. In other words, I do not have to accept a commission if I feel unable to complete it, I'm not comfortable, or any other reasons that may arise.
Both the artist and the client do not hold the right to use the work in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space. If any of my work is seen in relation to this technology, it is stolen.
I, the artist, do not allow my style to be replicated using A.I. generation or any A.I. technology/site. If you see work that I did not create by hand, it is theft.
You must be at least 18 years old to commission me. I understand younger clients may have permission to obtain artwork or have accounts of their own but, because of my working with Paypal, I don't want to risk any issues.
ii. payments & refunds
Payment is taken in USD through Paypal or Stripe invoice or through VGen directly. I do not do F&F on Paypal. I may consider alternative payment methods but the likelihood is not high due to restrictions.
Payment is taken in full after the initial sketch is approved. I require this to be done within 72 hours; I do not continue working on the commission until I receive it. If you need a little more time or would like to do a payment plan, please let me know.
At this time, I do not take refunds. Please be confident in your decision to commission me!
iii. commercial pricing
No commercial rights (a.k.a. personal use) is the default. It allows you to use the piece(s) for icons, headers, wallpaper, and so on.
Partial commercial rights is included and covers using the piece(s) for stream overlays, panels, schedules, and any other branding-adjacent intentions. Using art in videos, monetized or not, is included in this.
Full commercial rights is +200% of the price and includes the ability to profit directly off of the piece(s) in the form of merchandise and other direct promotional work you profit off of.
Even if commercial rights is purchased, I, the artist, still own the copyright to my work. I am not relinquishing that ownership.

iv. process and revisions
My general workflow for commissions is as follows: sketch → approval → payment → lining → approval → colouring and shading → finish.
In the sketch phase, there are unlimited revisions allowed. My sketching is a bit hard to decipher and is not truly a reflection of the final piece (stylistically), so there will be another opportunity to check in.
In the lining phase, there are both major and minor revisions allowed. It's not unlimited, per se, but I'm willing to do a fair bit of changes here.
Once the piece is finished, any major revisions that would require me to redraw and recolour the piece will incur a fee. This doesn't include adjustments like skin colour.
Despite my workflow, you are free to ask for updates and WIPs at any time. Unless I need further input or feedback, I will follow my workflow closely.
v. deadlines & delivery
Strict deadlines and rush orders are not available.
Generally speaking, my turnaround time is around 2-3 weeks minimum and up to 6 months maximum. If something comes up, I will communicate it immediately.
If I find that I can no longer complete the work, I will then decide to refund you (either in full or partially, based on the amount done).
No matter what, I will never leave you waiting for a commission / paid request for over a year. At least, not without proper communication beforehand.
vi. intellectual property rights
Do not edit, trace, or sell my artwork. For clarity, selling my artwork means to replicate and reproduce it for monetary gain. Those who purchase full commercial rights may disregard this.
I, the artist, will always hold the rights to any of the work I do. This means that I am allowed to post the works on any platform, promote myself with it in a portfolio, etc. If you, however, are not comfortable with this or wish for me to wait to show it, please let me know beforehand.
Clients of the commissioned pieces alone are allowed to repost their respective pieces with the watermark intact and with credit linking back to my VGen and/or my account if I exist on the platform.
discounted tos
These are the terms I use for my discounted commissions. Terms that differ from the default ToS are under Section III and IV.

live2d tos
These are the terms I use for my Live2D commissions; for now, it only covers rigging. All terms differ from the default ToS.
i. general terms
For Live2D commissions, personal and commercial use are both acceptable.
Rigging is intended for Vtube Studio use. I do not use Vbridger.
I, the artist, will always reserve the right to refuse any commission requests. In other words, I do not have to accept a commission if I feel unable to complete it, I'm not comfortable, or any other reasons that may arise.
There is no such thing as a rigging style belonging to a single person. I will never claim to own my rigging style, especially since it is ever-changing.
You must be at least 18 years old to commission me. I understand younger clients may have permission to obtain artwork or have accounts of their own but, because of my working with Paypal, I don't want to risk any issues.
Please, please, please understand that I am still very much learning how to rig. I will not have the same kind of ultra smoothness or bounciness as some other riggers do. Please look at my rigging examples before commissioning to see if it's something you really want for your model.

Unlike my other services, there is no clean-cut process for rigging. I may do things "out of order." However, I can give an approximate estimate.
My approximate workflow will be as follows: model inspection → head-centric rigging → body-centric rigging → refinement → finish. WIPs, revisions, and approval are constant in this process so they are omitted here for clarity.
I will also test the way the rig works in VTS but you are ultimately responsible for making the model work as you'd like it.
Although I am open to fixing your rig after we finish, I ultimately will not do any major revisions unless it's ruining the way the model functions.

Unless asked otherwise, I will likely be showcasing my rigged models on YouTube. Credits will be given where credit is due, I will never take credit for what isn't mine.
Always acknowledge me (@seraphlite) as your rigger! How you refer to me is ultimately up to you but I would prefer masculine or gender neutral terms, such as "Papa," "Parent," or "Rigger."
commercial use clarifications
This section serves as a clearer guideline for what constitutes as personal or commercial use. The very basic explanation is that if you don't intend on making money off of the art directly in any way, you are not going to be paying any commercial fees.

PERSONAL USE
Use of art as profile picture and/or banner/header on social media
Sharing artwork on social media or stream
Using artwork in social media posts non-commercially (see the full commercial equivalent)
Printing physical merchandise (e.g. apparel, art prints, keychains, acrylic stands) for yourself or friends with no intention to sell or give away to a larger, non-personal audience
Post onto character storage sites like Toyhou.se, UnVale, CharacterHub, and more.
